• If you experience pain, dizziness, illness, injury, or any concerning symptoms while following recommendations, discontinue the activity immediately and seek advice from a qualified healthcare professional.
• Use of GoFitYatra does not create any doctor-patient, dietitian-client, trainer-client, therapist-client, fiduciary, or healthcare professional relationship.

6. Subscriptions & Payments

Certain features of GoFitYatra may require payment. Pricing, billing cycles, trial periods, and cancellation terms are disclosed at the time of purchase. You may cancel paid subscriptions in accordance with the instructions provided in your account settings. Free trials, if offered, may be subject to eligibility criteria and may not be available on subsequent upgrades.

Subscription fees, billing intervals, renewal terms, cancellation policies, taxes, and any applicable trial conditions are disclosed before purchase. Unless otherwise stated, subscriptions renew automatically until cancelled. You are responsible for managing your subscription through the applicable platform or payment provider. Nothing in these Terms transfers ownership of GoFitYatra's software, designs, trademarks, branding, AI systems, or other intellectual property to you.

All third-party brand names, trademarks, and logos (including but not limited to grocery delivery platforms) are the property of their respective owners. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. WE DO NOT WARRANT THAT THE SERVICE WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, ERROR-FREE, OR THAT ALL INFORMATION OR AI-GENERATED OUTPUTS WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR PARTICULAR NEEDS.

11. Limitation of Liability

You voluntarily choose to participate in nutrition, exercise, and wellness activities. You acknowledge that such activities involve inherent risks and accept responsibility for your own decisions and actions while using the Service. To the maximum extent permitted under applicable law, GoFitYatra, its founders, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, health outcomes, injuries, allergic reactions, or other consequences arising from reliance on the Service or other intangible losses, arising out of or related to:

(i) your access to or use of, or inability to access or use, the Service;
(ii) reliance on any information, plans, recommendations, or AI-generated outputs provided through the Service;
(iii) any conduct or content of any third party, including integrations or external services;
(iv) unauthorized access to, use of, or alteration of your data or content;

This limitation applies to all claims, including those related to health, fitness, nutrition, or lifestyle outcomes resulting from use of the Service.

If you have not made any payments to GoFitYatra, GoFitYatra shall have no liability to you.

We continuously improve GoFitYatra and may modify, suspend, discontinue, or replace features at any time without prior notice. We do not guarantee uninterrupted availability of the Service and may perform maintenance or updates that temporarily affect access.

To the extent permitted by applicable law, you agree to indemnify and hold harmless GoFitYatra, Movind AI LLP, its founders, employees, affiliates, and service providers from claims, damages, liabilities, and expenses arising from your misuse of the Service, your violation of these Terms, or your violation of applicable law or the rights of others.

GoFitYatra shall not be responsible for any failure or delay in performance of the Service due to events beyond reasonable control, including but not limited to acts of God, natural disasters, public health emergencies, government actions, internet or infrastructure failures, labor disputes, or third‑party service outages.

We may suspend or terminate access to the Service if these Terms are violated or if required by law. You may stop using the Service at any time by discontinuing access or deleting your account, subject to applicable data retention obligations.

Certain provisions of these Terms, including those relating to intellectual property, disclaimers, limitation of liability, dispute resolution, indemnification, and governing law, will survive termination.

These Terms are governed by the laws of India. Any disputes shall be subject to the jurisdiction of courts located in India.

20. Dispute Resolution & Arbitration

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the Service, the parties shall first attempt to resolve the matter amicably through good‑faith discussions.

If such dispute is not resolved within a reasonable period, it shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be India, the arbitration proceedings shall be conducted in English, and the arbitral award shall be final and binding on the parties.
